ONYC® HAIR NIGERIA TERMS & CONDITIONS
Conditions of Use
Welcome to the ONYC® Hair Nigeria website at www.onychair.ng (the “Website”). The Website is operated for ONYC® Hair customers in Nigeria by ONYC® Hair Nigeria (“ONYC Hair Nigeria”, “ONYC”, “we”, “us”, or “our”). These Terms & Conditions explain the rules that apply when you visit the Website, create an account, place an order, communicate with us, participate in a promotion, submit content, or use any product, service, feature, or tool made available through the Website.
Please read these Terms & Conditions carefully because they contain important information about your rights and responsibilities, order processing, payments, deliveries, returns, product variations, dispute resolution, and limitations that may apply to your use of the Website. By accessing or using the Website, you agree to be bound by these Terms & Conditions, our PRIVACY POLICY, and any additional policy or notice expressly incorporated by reference.
Nothing in these Terms & Conditions is intended to remove, restrict, or exclude any consumer right or remedy that cannot lawfully be excluded under the Federal Competition and Consumer Protection Act 2018, the Nigeria Data Protection Act 2023, or any other applicable Nigerian law. Where any provision of these Terms & Conditions conflicts with a mandatory legal right, the mandatory legal right will apply.
If you do not agree with these Terms & Conditions, you must not use the Website or place an order through it.
About ONYC® Hair Nigeria
ONYC® Hair Nigeria is the Nigerian online storefront for genuine ONYC® Hair products made available through this Website. References to “customer”, “you”, or “your” mean the person visiting the Website, creating an account, submitting information, or purchasing a product. References to “products” include hair extensions, wigs, closures, frontals, clip-ins, accessories, samples, and any other item offered through the Website.
Business identity, customer-service channels, and available contact details for the operator of this Website are provided on our CONTACT US page. Customers should use the contact details displayed on the Nigerian Website rather than contact information displayed on an ONYC website for another country.
Eligibility and Age Requirement
You must be at least eighteen (18) years old and legally capable of entering into a binding contract to create an account or place an order through the Website. A person under eighteen may use the Website only with the involvement, consent, and supervision of a parent or legal guardian who accepts responsibility for the use of the Website and any resulting transaction.
You may not use the Website, create an account, place an order, or participate in any promotion or communication programme where doing so is prohibited by applicable law.
Account Registration and User Responsibilities
Where account registration is required, you agree to provide accurate, current, and complete information. You are responsible for keeping your login details confidential and for all activity carried out through your account, except where the activity resulted from a security failure for which ONYC Hair Nigeria is legally responsible.
We may limit customers to one account per person unless we approve otherwise. You must not create accounts using false information, impersonate another person, or use another person’s payment or contact details without permission. Usernames may not be changeable after registration, although other account details may be updated where the Website permits.
You must notify us promptly if you believe your account has been accessed without authorisation or if your account details are no longer accurate. We may suspend or restrict an account where reasonably necessary to protect the customer, ONYC Hair Nigeria, our payment partners, or other users.
Prohibited Uses
You must not use the Website, its checkout, account features, forms, reviews, content, or communication tools for any unlawful, fraudulent, abusive, harmful, misleading, or unauthorised purpose. Prohibited conduct includes submitting false information; impersonating another person; using stolen or unauthorised payment details; interfering with Website security; attempting to gain unauthorised access to systems or accounts; introducing viruses, malware, or harmful code; scraping or harvesting information without written permission; spamming, phishing, or conducting fraud; violating intellectual-property or privacy rights; manipulating reviews or promotions; placing orders for unauthorised resale; or engaging in conduct that may harm ONYC Hair Nigeria, our customers, our service providers, or any third party.
We may investigate suspected misuse, cancel or restrict affected transactions, suspend access, preserve relevant records, and report suspected unlawful activity to payment providers, delivery partners, regulators, or law-enforcement authorities where appropriate and permitted by law.
Right to Change or Suspend the Website
We may modify, update, suspend, restrict, or discontinue any part of the Website or any product, content, feature, service, or promotion at any time. We may also carry out maintenance, security updates, or technical changes that temporarily affect Website availability.
Changes to the Website will not remove rights that have already arisen under an accepted order or applicable law. We will not be liable for temporary unavailability caused by maintenance, technical problems, third-party service failures, events outside our reasonable control, or necessary security action, except to the extent liability cannot lawfully be excluded.
Website Content and Permitted Use
The Website and its contents are provided primarily for personal shopping, product education, and non-commercial use. You may view, download, or print limited Website material for your own personal use, provided you do not remove ownership notices or alter the material.
You may not reproduce, republish, transmit, distribute, display, sell, licence, modify, create derivative works from, commercially exploit, or otherwise use any Website content without our prior written permission, except where the law expressly permits such use.
Product-care, styling, installation, and maintenance information on the Website is general information only. It is not medical advice and does not replace advice from a qualified hairstylist, cosmetologist, dermatologist, or other appropriate professional. Stop using a product and seek appropriate professional advice if you experience pain, irritation, allergic symptoms, scalp injury, unusual shedding, or another adverse reaction.
Copyrights, Trademarks, and Intellectual Property
The ONYC® name, ONYC® logos, product names, photographs, videos, graphics, designs, text, product descriptions, Website layout, software, and other content are owned by or licensed to ONYC Hair Nigeria, ONYC International, or their respective licensors and are protected by applicable intellectual-property laws.
Images of people, hairstyles, products, and locations displayed on the Website are owned by or used with permission of the relevant rights holder. Unauthorised use may violate copyright, trademark, privacy, publicity, passing-off, or other legal rights. No licence or right is granted except the limited personal-use permission expressly stated in these Terms & Conditions.
Third-Party Links, Tools, and Services
The Website may use or link to third-party payment processors, banks, delivery companies, social-media platforms, review platforms, analytics services, customer-support tools, messaging providers, fraud-prevention services, and other external services. Those services are not necessarily owned or controlled by ONYC Hair Nigeria.
We do not guarantee the content, security, availability, accuracy, policies, products, or services of an independent third party. Your use of an external service may be governed by that provider’s own terms and privacy policy. This does not limit any responsibility ONYC Hair Nigeria may have under applicable law for the providers we appoint to process an order or personal data on our behalf.
Personal Information Submitted Through the Website
Our collection and use of personal information through the Website are governed by our PRIVACY POLICY. The Privacy Policy explains the categories of information we collect, why we process it, the lawful bases we rely on, how we share and protect it, international or cross-border processing, retention, cookies, and the rights available to data subjects.
By submitting information, you confirm that the information is accurate and that you have authority to provide it. Where you provide another person’s information—for example, a recipient’s name, telephone number, or delivery address—you confirm that you are authorised to do so and that the information may be used to fulfil the order.
Marketing Communications
Where permitted by law, we may send you marketing communications about ONYC® Hair products, offers, rewards, events, reviews, restocks, and related news. We will rely on consent or another lawful basis recognised under applicable Nigerian data-protection law.
You may opt out of marketing emails at any time through the unsubscribe link included in the message. You may opt out of other marketing channels by following the instructions in the communication or contacting us. Opting out of marketing does not prevent us from sending necessary service communications about an account, order, payment, delivery, security issue, policy change, complaint, or return.
SMS, MMS, and WhatsApp Messaging Terms
ONYC Hair Nigeria may offer communications through SMS, MMS, WhatsApp, or another mobile messaging service. Messages may include order confirmations, payment notices, delivery updates, customer-service responses, security alerts, cart reminders, product information, review requests, rewards, promotions, or event notices.
Consent and Opt-In: Where consent is required, you may opt in by providing your mobile number through the Website, checkout, an account form, pop-up, subscription form, keyword, customer-service interaction, or another clearly identified enrolment method. Marketing consent is voluntary and is not a condition of purchasing a product.
Transactional Messages: When you place an order or request support, we may send service messages reasonably necessary to process the transaction, verify information, prevent fraud, coordinate delivery, respond to you, or administer a return. These are not promotional messages merely because they mention the product or order involved.
Message Frequency and Charges: Message frequency varies according to your activity and preferences. Your mobile network, internet provider, or messaging platform may charge for data, SMS, MMS, roaming, or other services. ONYC Hair Nigeria is not responsible for charges imposed by your provider.
Opt-Out: You may withdraw consent to marketing messages at any time by using the unsubscribe or opt-out instruction provided, replying STOP where that function is supported, changing your preferences where available, or contacting us with a clear request to stop marketing. We may send one final message confirming the opt-out. You may continue to receive essential order or service communications where legally permitted.
Help: For support, follow the help instruction in the message or use our CONTACT US page. A general customer-service request will not automatically opt you out unless you clearly ask us to stop the relevant marketing messages.
Mobile Number Ownership: You confirm that you are the subscriber or authorised user of the number you provide. If your number is changed, transferred, deactivated, cancelled, sold, or reassigned, you should opt out and notify us so that communications are not sent to a new user of the number.
Service Providers: We may use messaging, customer-relationship, telecommunications, analytics, and platform providers to operate the programme. Their processing of personal data will be handled in accordance with our Privacy Policy and applicable law. We do not sell mobile numbers or messaging opt-in records to third parties for their own independent marketing.
Delivery: Message delivery depends on networks, devices, internet access, platform availability, and accurate contact information. Delayed, blocked, or undelivered messages may occur and are not guaranteed.
Age: You must be at least eighteen (18) years old to opt in independently. A person under eighteen may participate only with the permission and supervision of a parent or legal guardian, where legally permitted.
Other Submissions
Apart from personal information governed by our Privacy Policy, any non-confidential idea, suggestion, question, proposal, or other material voluntarily submitted to us may be used to operate, improve, promote, or develop our products and services. This does not give us ownership of material where ownership cannot lawfully be transferred without a separate written agreement.
Do not submit confidential business information, trade secrets, third-party content you are not authorised to share, or material that you expect us to keep confidential unless we have agreed in writing to receive it on that basis.
User Comments, Reviews, Feedback, and Media
We welcome genuine reviews, comments, photographs, videos, and feedback. By submitting content to us or tagging ONYC® Hair in content that you expressly authorise us to use, you grant ONYC Hair Nigeria and the ONYC brand a non-exclusive, worldwide, royalty-free licence to reproduce, edit, translate, publish, display, distribute, and use that content for Website, social-media, advertising, customer-service, training, and promotional purposes, subject to applicable privacy and intellectual-property law.
You confirm that your submission is accurate, reflects your genuine experience where presented as a review, does not infringe another person’s rights, and is not unlawful, defamatory, abusive, discriminatory, obscene, deceptive, or harmful. You must disclose any material connection, reward, gift, or incentive associated with a review where required.
We may moderate, refuse, edit, or remove submissions for legal, security, relevance, privacy, authenticity, or policy reasons. We will not deliberately suppress a genuine negative review solely because it is negative. We are not obliged to publish every submission, pay compensation, or respond.
Product Information and Customer Responsibility
Each product page may contain an overview, description, details, specifications, care information, texture guidance, colour guidance, size or weight information, photographs, videos, frequently asked questions, and links to related policies. You are responsible for reviewing the full product page and selecting the correct product, texture, colour, length, quantity, attachment method, and other available options before completing checkout.
Product recommendations, quizzes, matching assistance, and customer-service guidance are intended to help you decide, but the final choice remains yours unless we expressly confirm in writing that a particular product is guaranteed to meet a specific requirement. For installation, chemical processing, colouring, cutting, heat styling, or significant alteration, we recommend using an appropriately qualified professional.
Colour Display and Natural Colour Variation
We make reasonable efforts to display product colours accurately. However, studio lighting, screen settings, browser settings, device type, photography, editing, and surrounding colours can affect how a shade appears. Website images and colour charts are therefore guides and are not guarantees of an exact screen-to-product colour match.
Natural Black and Natural Brown Hair: Natural hair colours vary because individual pieces may come from different donors or production batches. Natural Black and Natural Brown may include warmer, cooler, lighter, darker, or mixed undertones. We cannot guarantee an identical shade across every bundle, closure, frontal, clip-in piece, or order.
You may include a colour preference in the order note, and we will make reasonable efforts to match it from available inventory. A minor natural colour variation that remains within the product description is not automatically a defect. This does not affect your rights where the item is materially different from its description, incorrectly supplied, or otherwise fails to meet a mandatory legal standard.
Texture Display and Natural Hair Characteristics
ONYC® Hair products may be made with real human hair. Real hair naturally varies between donors and batches. Hair may differ slightly in strand diameter, density, lustre, softness, coarseness, curl formation, wave pattern, colour undertone, porosity, reaction to humidity, and response to products or heat.
Where a curl or wave pattern has been processed, the hair may still retain natural characteristics that affect its finished appearance and maintenance needs. Product images and texture categories show the intended general family or pattern, not a guarantee that every piece will be identical.
A minor variation that is normal for genuine human hair and remains consistent with the product description is not automatically a defect. This does not affect your rights where the product is materially misdescribed, damaged, defective, or not fit for a purpose that we expressly accepted.
Image Display and Styled Results
Images and videos may show hair that has been washed, conditioned, layered, curled, straightened, coloured, cut, blended, professionally installed, or photographed under studio lighting. The final result will depend on the amount purchased, the customer’s natural hair, installation method, stylist technique, cut, products, maintenance, climate, and styling.
Use images as styling and appearance guides. The written product name, selected options, product specifications, and order confirmation determine what you are purchasing.
Errors, Inaccuracies, and Omissions
We try to keep product descriptions, prices, offers, stock levels, images, and Website information accurate. Occasionally, information may contain a typographical, technical, pricing, availability, or other error.
Where we discover a material error before accepting or dispatching an order, we may correct the information and contact you. You may choose to proceed at the correct price or with the corrected information, select an available alternative, or receive a refund for the affected item. We will not charge an increased amount without your agreement.
Where an obvious pricing error could reasonably have been recognised as an error, we may decline the affected order and refund any payment received. Nothing in this section permits misleading pricing or removes any remedy available under applicable consumer law.
Pricing, Currency, and Taxes
Unless clearly stated otherwise, prices on the ONYC Hair Nigeria Website are displayed in Nigerian Naira (NGN/₦). Prices may change without prior notice, but a price change will not alter the price of an order we have already accepted unless you agree to the change or an obvious error applies.
Applicable taxes, including Value Added Tax where chargeable, will be included in the displayed price or clearly shown during checkout in accordance with the tax rules and rate in force at the time of the transaction. Delivery charges, insurance charges, international duties, and other optional costs will be shown separately where applicable.
Clearance, discontinued, sample, or final-sale products may have restricted return eligibility where this is clearly disclosed before purchase and permitted by law. A “final sale” notice does not remove rights relating to defective, unsafe, counterfeit, materially misdescribed, or incorrectly supplied goods.
Payment Options and Payment Terms
We accept the payment methods displayed at checkout. Depending on availability, these may include debit or credit cards, bank transfer, payment links, digital payment methods, or other services offered through an approved payment provider. Payment is generally required in full before an order is processed unless we expressly offer another arrangement.
Your bank or payment provider may place an authorisation hold or debit your account when you submit an order. A successful payment notification does not by itself guarantee acceptance or immediate dispatch. If we decline or cannot fulfil an order after payment, we will initiate a refund through the original payment method or another lawful method agreed with you.
You are responsible for bank charges, transfer fees, foreign-exchange charges, or other costs imposed by your financial institution unless we expressly agree otherwise. For bank-transfer orders, processing may not begin until cleared funds are received and matched to the order.
We take payment fraud seriously. We may use fraud screening, request reasonable identity or address verification, delay processing while checks are completed, restrict delivery options, cancel suspicious orders, or report suspected fraud. Any verification request will be limited to information reasonably necessary for security and handled in accordance with our Privacy Policy. Never send a card PIN, one-time password, or full card-security code to ONYC Hair Nigeria.
Please review our PAYMENT INFORMATION page for any additional payment instructions displayed on the Website.
Promotions, Coupons, Rewards, and Gift Offers
Promotional codes, discounts, rewards, referral benefits, free gifts, sale events, or other offers may be subject to additional conditions, including an expiry date, qualifying products, minimum spend, territory, customer eligibility, usage limit, or restriction against combining offers.
A promotional code must be applied before the order is completed unless the offer expressly states otherwise. A code has no cash value, may not be sold or transferred unless permitted, and cannot reduce an order below zero. If an order is cancelled, refunded, or returned, the value of the promotion may be deducted or restored in accordance with the stated offer terms and applicable law.
We may refuse or reverse a promotion obtained through error, manipulation, duplicate accounts, automated activity, misrepresentation, or other abuse. We will not withdraw a properly applied promotion from an accepted order without a lawful reason.
Product Availability
Products are subject to availability. Stock information is updated regularly but may occasionally be inaccurate because of timing, technical error, damaged inventory, quality-control rejection, or simultaneous orders.
If an item becomes unavailable or cannot pass quality control, we will contact you and offer an available alternative, revised fulfilment date, partial fulfilment, store credit where you choose it, or a refund for the unavailable item. We will not substitute a materially different product without your agreement.
Order Submission, Validation, Acceptance, and Confirmation
Submitting an order is an offer to purchase the selected products. An automated order-received or payment message confirms that we received the submission; it does not necessarily mean that the order has been accepted.
We may validate product availability, payment, delivery details, security information, and compliance with these Terms & Conditions before accepting the order. A contract is formed when we expressly confirm acceptance, begin fulfilment in a manner communicated to you, or dispatch the order, whichever occurs first.
We may decline or cancel an order before acceptance for a lawful reason, including unavailable stock, inability to verify payment or delivery details, suspected fraud, a Website error, pricing error, prohibited use, order-limit violation, or an address we cannot serve. If payment has been collected, we will initiate a refund for the declined portion.
Unless we approve otherwise in writing, products purchased through the retail Website are for personal use and not for unauthorised commercial resale, distribution, or marketplace listing.
Order Processing
A confirmed order normally requires up to two (2) business days for verification, quality control, packing, and handover to the delivery provider, unless a different processing time is stated on the product page, at checkout, or in the order confirmation. Custom, pre-order, back-order, colour-treated, special-request, or high-volume orders may require additional time.
Business days exclude Saturdays, Sundays, and Nigerian public holidays. Processing and delivery estimates are separate. An expedited delivery service shortens the carrier’s transit period after dispatch; it does not necessarily shorten payment verification, quality control, or order preparation.
We may contact you for clarification or verification. A delay caused by missing, inaccurate, or unverified information will not count as part of the standard processing estimate. For security, value, or delivery reasons, some orders may require signature, identification, a delivery code, or another reasonable confirmation at handover.
Order Changes and Cancellations
Contact us as soon as possible if you wish to change or cancel an order. We will make reasonable efforts to assist before the order enters active fulfilment, customisation, packing, or dispatch, but a requested change is not effective until we confirm it in writing.
Where an order has not yet been processed or dispatched, cancellation may be accepted subject only to any reasonable, disclosed, and lawful charge for costs already incurred. Once an order has entered fulfilment or has been dispatched, cancellation may no longer be possible, and the Return & Exchange Policy will apply.
Custom-made, specially coloured, altered, pre-ordered, personalised, or specially sourced items may not be cancellable once production, sourcing, or alteration has begun, except where required by law or where the product is defective, unsafe, materially misdescribed, or not supplied as agreed.
This section does not remove any statutory cancellation, refund, or return right available to a consumer under applicable Nigerian law.
Order Limitations and Restricted Quantities
We may set reasonable limits on quantities purchased per person, account, household, payment method, address, promotion, or order. Limits may be used to protect stock availability, prevent fraud, enforce promotion rules, or prevent unauthorised resale.
Where we reduce or cancel a quantity, we will attempt to notify you using the contact information on the order and will refund any amount paid for products we do not supply.
Nigeria Delivery, Shipping, and Order Tracking
Orders for delivery within Nigeria are shipped using the delivery options available for the destination at checkout. Charges and estimated delivery periods depend on location, service level, package value, package size, security requirements, and carrier availability.
Delivery estimates begin after dispatch and are estimates rather than guaranteed delivery dates unless we expressly describe a service as guaranteed. Delays may be caused by weather, traffic, public holidays, security conditions, remote locations, address problems, carrier capacity, customs or regulatory action, or events outside our reasonable control.
When tracking is available, we will send it to the email address, telephone number, account, or communication channel connected to the order. You are responsible for monitoring tracking, keeping your contact details active, and responding promptly to reasonable delivery requests.
You must provide a complete and accurate address, including state, city, area, street information, landmarks where reasonably needed, and an active Nigerian telephone number. Additional charges may apply where a package must be redirected, returned, stored, or reshipped because of an incorrect or incomplete address, repeated failed delivery, refusal without legal justification, or failure to collect the parcel. We will disclose and explain any additional charge before reshipping.
Risk of loss or damage will pass in accordance with applicable Nigerian consumer law. A carrier’s scan or proof of delivery may be used as evidence of delivery, but it does not prevent you from raising a genuine complaint about non-receipt, damage, or delivery to the wrong person.
Please review our SHIPPING POLICY for available services, rates, estimated transit periods, delivery areas, and additional requirements.
International Orders Placed Through the Nigeria Website
Where the Website permits delivery outside Nigeria, available payment and shipping methods will be shown at checkout or confirmed by customer service. We may restrict countries, products, values, or payment methods for legal, logistical, security, or fraud-prevention reasons.
The recipient is responsible for import duties, customs charges, clearance fees, local taxes, brokerage costs, and other destination-country charges unless checkout expressly states that they are included. Customs processes may delay delivery, and ONYC Hair Nigeria cannot control the decisions or processing times of a foreign authority.
A customer placing an international order must ensure that the product may lawfully be imported into the destination and that the address and recipient details meet local delivery requirements.
Lost, Delayed, Damaged, or Misdelivered Parcels
Contact us promptly if tracking does not update for an unusual period, a parcel is marked delivered but has not been received, the packaging arrives damaged, items are missing, or the parcel appears to have been delivered to the wrong person.
Where reasonably possible, provide the order number, tracking number, photographs of the parcel and label, photographs of damage, delivery messages, and any other relevant information. Keep the packaging and contents until the review is completed.
We may ask the carrier to investigate and may require a truthful declaration of non-receipt or damage. Investigation time depends on the carrier and circumstances. This process does not remove any remedy you have under applicable consumer law.
Where optional delivery insurance is offered, its terms will be disclosed before purchase or in our INSURANCE POLICY. Failure to purchase optional insurance does not remove any responsibility that the law places on ONYC Hair Nigeria.
Returns, Exchanges, Refunds, and Store Credit
All returns, exchanges, refunds, and store-credit requests are subject to our RETURN & EXCHANGE POLICY and applicable Nigerian consumer law.
Inspect every product immediately after delivery and before removing security ties, labels, seals, bands, tags, or original packaging. Confirm the product name, colour, texture, length, quantity, weft condition, lace condition, clips, tips, and other relevant features before installation, cutting, colouring, washing, chemical processing, adhesive application, or other alteration.
Because hair products are personal-use and hygiene-sensitive items, a non-defective product may be ineligible for return after a hygiene seal, security tie, label, or protective packaging has been removed, or after the product has been worn, installed, cut, coloured, washed, chemically treated, altered, or exposed to products or odours. Any such restriction will apply only where it was clearly disclosed and is lawful.
Hygiene restrictions do not remove rights relating to goods that are defective, unsafe, counterfeit, materially misdescribed, incorrectly supplied, or otherwise fail to meet a mandatory legal standard. Where a return is accepted, the available remedy may be repair where appropriate, replacement, exchange, refund, or store credit, depending on the reason for the return, the customer’s lawful entitlement, product availability, and the option selected by the customer where a choice is available.
Any refund will normally be issued through the original payment method unless another lawful method is agreed. Bank and payment-provider processing times may apply after we initiate the refund. Original delivery charges and return-delivery costs will be handled according to the reason for return and applicable law. Where the return results from our error or a validated defect, we will provide the remedy and reasonable return arrangement required by law.
Minor natural colour or texture variation that remains within the product description is not automatically a defect. However, we will assess complaints fairly and will not rely on a “natural variation” statement to excuse a materially different, defective, or incorrectly supplied product.
Product Defects, Quality Complaints, and Replacements
ONYC Hair Nigeria applies quality-control procedures before dispatch. You should still inspect the product immediately and carry out any reasonable, non-destructive strand or appearance check before removing security attachments or installing the hair.
If you believe a product is defective, contact us promptly after discovering the issue. Where the hair has been installed, contact us as soon as reasonably possible and, where practicable, within fourteen (14) calendar days of delivery so that the condition can be assessed before further use, product build-up, chemical processing, or maintenance makes the cause difficult to determine. This notification request does not shorten any longer mandatory right provided by law.
We may request the order number, detailed description, care and installation history, photographs, videos, products used, stylist information, and return of the affected item for inspection. You may need to uninstall the extension where physical inspection is reasonably necessary. Do not discard the product or packaging while a complaint is under review.
If we validate a defect or other failure covered by law or policy, we will provide an appropriate remedy, which may include replacement, exchange, refund, repair where suitable, or another agreed resolution. If inspection shows that the issue resulted from incorrect installation, misuse, excessive heat, bleaching, chemical damage, cutting, incompatible products, poor maintenance, normal wear, or another cause for which ONYC Hair Nigeria is not responsible, we may decline a defect claim and may require the customer to pay return or reshipping costs. We will explain the basis of the decision.
Where a customer chooses a higher-priced replacement that is not required as the legal remedy, the customer must pay the price difference. If the replacement is lower priced, any required balance will be handled in accordance with the agreed remedy and applicable law.
Return and Payment Fraud
Return fraud includes knowingly returning a counterfeit or substituted product, returning an item not purchased from ONYC Hair Nigeria, falsely claiming that an item was missing or different, manipulating evidence, using a product temporarily with a pre-existing intention to return it improperly, or seeking multiple refunds for the same transaction.
We may refuse a fraudulent request, suspend related accounts, preserve evidence, recover losses through lawful means, and report suspected fraud to payment providers, delivery companies, regulators, or law-enforcement authorities. Genuine complaints and good-faith mistakes will not be treated as fraud merely because a claim is not ultimately accepted.
Product Care, Installation, and Customer-Caused Damage
Human-hair products require suitable handling and maintenance. Product life and appearance depend on installation, detangling, washing, conditioning, drying, product choice, heat, chemical processing, climate, storage, frequency of use, and the customer’s natural hair and scalp condition.
Unless a product is expressly sold for a particular chemical process, we do not guarantee the outcome of bleaching, colouring, relaxing, perming, adhesive use, excessive heat, or another alteration. Such services should be performed by an appropriately skilled professional after a strand test. Damage caused by misuse, improper installation, incompatible products, neglect, unauthorised alteration, or failure to follow care guidance is not a manufacturing defect.
Disclaimers and Statutory Rights
The Website is provided on an “as available” basis. We do not guarantee that the Website will always be uninterrupted, error-free, secure, or free from every harmful component, although we take reasonable measures to operate and protect it.
To the fullest extent permitted by law, we do not make warranties beyond those expressly stated on the Website, in an accepted order, or required by law. Nothing in these Terms & Conditions excludes or limits any implied condition, guarantee, warranty, quality standard, or consumer remedy that cannot lawfully be excluded.
Customer testimonials, photographs, videos, and styled results reflect individual experiences. Results vary and are not a guarantee that every customer will obtain the same appearance, longevity, colour result, curl pattern, or styling outcome.
Limitations of Liability
Nothing in these Terms & Conditions limits or excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, breach of a mandatory consumer right, unlawful processing of personal data, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above and to the fullest extent permitted by law, ONYC Hair Nigeria will not be liable for indirect, incidental, special, punitive, or consequential loss that was not reasonably foreseeable when the contract was formed, including loss of profit, business opportunity, goodwill, anticipated savings, or data, arising from personal use of the Website or products.
Where liability may lawfully be limited, our aggregate liability arising from a particular product order will not exceed the amount paid for the affected product and the related delivery charge. This limitation does not apply where the law requires a different remedy or amount.
We are not responsible for loss caused by inaccurate information supplied by the customer, failure to follow care or installation instructions, unauthorised account use not resulting from our breach, third-party services outside our reasonable control, or an event described under Force Majeure, except to the extent the law provides otherwise.
Indemnification
To the extent permitted by law, you agree to compensate ONYC Hair Nigeria for reasonable loss, damage, cost, or expense directly arising from your fraudulent or unlawful use of the Website, deliberate infringement of another person’s intellectual-property or privacy rights, submission of content you had no right to provide, or material breach of these Terms & Conditions.
This indemnity does not require a consumer to compensate ONYC Hair Nigeria for loss caused by our own breach, negligence, unlawful conduct, or failure to meet a mandatory obligation.
Force Majeure and Events Outside Reasonable Control
We will not be responsible for delay or failure caused by an event outside our reasonable control, including severe weather, flood, fire, epidemic, pandemic, civil disturbance, security incident, road closure, government action, customs delay, strike not limited to our own workforce, telecommunications failure, payment-system outage, electricity disruption, cyberattack despite reasonable safeguards, carrier interruption, or supply-chain disruption.
We will take reasonable steps to reduce the effect of the event and resume performance. If a material delay continues, we will communicate available options, which may include waiting, selecting an alternative, cancelling the affected unfulfilled portion, or receiving a refund where required.
Complaints and Dispute Resolution
We want to resolve complaints fairly and promptly. Before beginning formal proceedings, please contact us in writing with your name, order number, contact information, a clear description of the issue, relevant evidence, and the outcome you are requesting.
The parties should first try in good faith to resolve the dispute directly. Unless urgent relief is reasonably necessary, each party should allow the other a reasonable opportunity to investigate and respond, normally up to thirty (30) days after receiving sufficient information.
Where direct resolution is unsuccessful, the parties may agree to mediation or another recognised alternative dispute-resolution process. Nothing in these Terms prevents a consumer from submitting a complaint to the Federal Competition and Consumer Protection Commission, the Nigeria Data Protection Commission for an applicable data-protection matter, another competent regulator, or a court of competent jurisdiction.
Any arbitration will take place only where the parties validly agree to arbitration and will be conducted in accordance with applicable Nigerian law. This section does not compel a consumer to surrender a mandatory right or remedy.
Governing Law and Jurisdiction
These Terms & Conditions and contracts formed through the ONYC Hair Nigeria Website are governed by the laws of the Federal Republic of Nigeria, including applicable consumer-protection and data-protection laws, without prejudice to any mandatory protection that applies to a customer in another jurisdiction.
Subject to the Complaints and Dispute Resolution section, disputes may be brought before a court of competent jurisdiction in Nigeria. Nothing in this provision prevents a consumer from using a competent regulator or forum that the law makes available.
Severability
If a provision of these Terms & Conditions is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or modified only as necessary to make it lawful. If it cannot be preserved, it will be treated as severed. The remaining provisions will continue in effect.
No Waiver
A delay or failure by ONYC Hair Nigeria to exercise a right does not waive that right. A waiver is effective only if clearly made in writing and applies only to the specific matter for which it is given.
Assignment
You may not transfer an accepted order or your rights under these Terms & Conditions to another person without our consent, except where the law permits. We may transfer our rights or obligations as part of a lawful restructuring, sale, brand operation, service arrangement, or transfer of business, provided this does not reduce your mandatory rights.
Entire Agreement
These Terms & Conditions, the Privacy Policy, the Return & Exchange Policy, Shipping Policy, Payment Information, product-page terms, promotion rules, and any other policy expressly incorporated by reference form the agreement between you and ONYC Hair Nigeria concerning your use of the Website and purchase of products.
Nothing in this section excludes a statement or representation that the law treats as binding or prevents a remedy for fraud or misleading conduct.
Changes to These Terms & Conditions
We may update these Terms & Conditions to reflect changes in law, regulation, Website features, payment methods, delivery services, products, security practices, or business operations. The current version and its update date will be posted on this page.
Updated terms apply from the stated effective date and will not retrospectively remove rights under an order already accepted. Your continued use of the Website after an update means that the revised terms apply to later use and later transactions.
Termination or Restriction of Use
We may suspend, restrict, or terminate your access to the Website or an account where reasonably necessary because of unlawful activity, fraud risk, security concerns, abuse, repeated material breach, or harm to other users or our operations.
Termination does not remove rights or obligations that arose before termination, including payment obligations, accepted-order rights, intellectual-property protections, complaint rights, return rights, and provisions intended to continue by their nature.
